Ok crew. I need the Fediverse brains trust with this one. I'm using Fastmail as my email provider right now. It's ok, has good features. But I'm just concerned that it's not the most secure provider out there. I have a free tier account with proton, but lately I've been a bit disappointed in their decision making and not sure I want to sign up for a paid account. I know #tuta is often recommended. #mailbox.org also. What about #soverin ?

So many people on social media twist everything to fit their personal agendas. It's infuriating.
There are posts accusing #Proton of turning over personal information to the FBI, and many people are framing this as proof that Proton's claims of privacy are untrue. Some use it to convince people to use #Tuta email instead.
None of these people read anything about what happened.
1. Both Proton and Tuta clearly say they will honor court orders from Switzerland and Germany, respectively.
2. Proton was ordered by the Swiss government, responding to a treaty with the U.S., to turn over payment information for the person in question. Proton ignored direct FBI requests, as they said they would.
3. Germany has the same treaty with the U.S., and so if it were Tuta, they would also have turned over the same payment information for that person.
4. Both companies store end-to-end encrypted emails. Therefore, neither could hand over emails. Proton did not provide emails. They only provided the payment information required by the Swiss subpoena. The FBI then used the payment information to identify the person they were looking for.
There is no violation of their terms or promises. Tuta would have had to do the same thing because both Switzerland and Germany have the "Mutual Assistance Legal Agreement" with the U.S.
The lesson here is not that encrypted emails are unsafe, as some have posted, or that Proton broke their promises. The lesson is that if you don't want to be identified when either provider is forced to hand over payment metadata, then pay them with cryptocurrency. Don't use a credit card.
