Sotomayor, Jackson dissent.
Unfortunately, decision affirms the 5th Circuit AND allow many tobacco sellers to forum-shop their cases to the 5th Circuit, where they are nearly guaranteed to win in challenges to FDA regulations. It is wrong on the law, IMO, and bad for public health.

#SCOTUS third decision is a 6–3 split, conservatives vs. liberals, in McLaughlin v. McKesson, with Kavanaugh writing for the court. This bad outcome further weakens the power of federal agencies, an ongoing project for the supermajority.
At least we get a spicy dissent from Kagan, joined by Sotomayor and Jackson, in McLaughlin, accusing the conservative supermajority of "undermin[ing] the stability and efficacy of administrative programs." (She is clearly correct.)

The immediate impact will be muted because Congress just passed a bill purporting to abolish Calif's ability to set higher emissions standards than the rest of the country, which Trump signed. But there will now be a long legal battle over THAT measure's legality.
