This will be an important case. If SCOTUS throws out application of obstruction to Jan6, those who PLANNED to obstruct vote certification could only face misdemeanors, whereas those who got caught up, could face civil disorder charges. #legal
Josh Gerstein:
After years of dodging and weaving about the gravity of #Jan6 , #SCOTUS seems likely to grapple with the subject as it considers whether an obstruction charge used against hundreds of rioters was misapplied.

“The Supreme Court's conservative majority appeared skeptical of the Justice Department's position during oral arguments over whether a federal obstruction law can be used to prosecute some of the rioters [sic] involved in the #Jan6, 2021, attack on the US Capitol.” #SCOTUS
I wonder if Clarence Thomas will rule in favor of his insurrectionist wife in the arguments he is hearing today.
What major suspense, intolerable uncertainty. How can we be expected to sit here not knowing if he will side with his wife or not. More tense than all the thrillers ever made, sure, but: is it fair to leave us not knowing if his wife will be able to join him on the next vacation his is gifted without it being awkward?
These are the real questions, right? /s

On the bright side: If #SCOTUS rules (in June) in as horrible a way as they might, then Jack Smith could issue a report on ANYTHING else he found that would be immunized under their shitty rule before the election.

#SCOTUS is hearing arguments on whether hospitals must provide emergency #abortions in states w bans.
At issue is a nearly 40-yr-old fed law that requires hospitals that receive fed funds to stabilize or transfer all emergency patients, regardless of their ability to pay. Biden admin invoked the Emergency Medical Treatment and Labor Act to argue that the federal government has the power to penalize hospitals that fail to provide emergency abortions even in states with strict bans.
